Article 1 according to the regulations of the people's Republic of China on the administration of standardization and the trial regulations on the production license of industrial products, these measures are formulated to strengthen the supervision and inspection management of the quality of special labor protection products, ensure the safety and health of workers in the process of labor, and promote the smooth development of production and construction

Article 3 the Ministry of labor and personnel, according to the number and distribution of national labor protection product production enterprises and even the occurrence of black spots, Be responsible for planning and coordinating the business division and inspection scope of national labor protection product quality supervision and inspection center and local labor protection product quality supervision and inspection station; Together with the National Bureau of standards, a national labor protection product quality supervision and inspection center was established

the labor departments of all provinces, autonomous regions and municipalities directly under the central government may set up labor protection product quality supervision and inspection stations according to the actual situation, which shall be approved by the local relevant departments and reported to the Labor Protection Bureau of the Ministry of labor and personnel for the record

(I) implement the national guidelines, policies and regulations on product quality supervision

(II) regularly recheck or spot check labor protection products. If the product quality is found to be lower than the national standard, a warning or notification shall be given according to the specific situation; If the circumstances are serious, a fine shall be imposed in accordance with the market regulation that there will be tens of billions of dollars in the future; If necessary, it may suggest the issuing department to revoke its production license for labor protection products

(III) be entrusted by relevant departments to issue product inspection certificate

(IV) organize or participate in the evaluation and certification of high-quality products

(V) arbitrate product quality disputes and participate in dealing with major quality accidents

(VI) formulate inspection implementation rules and inspection charging methods, and submit them to the Ministry of labor and personnel for approval and implementation

(VII) unify the inspection methods of similar products, guide and train inspectors at all levels

(VIII) undertake or participate in the formulation, revision and verification of national standards

(I) implement the guidelines, policies and regulations related to product quality supervision under the unified planning and arrangement of the state

(II) participate in the review of high-quality products and organize the inspection of excellent products

(III) supervise and inspect the products produced and distributed locally, urge and inspect the enterprises to strictly implement the national and local standards, and issue the product inspection certificate entrusted by the national quality inspection center

(IV) arbitrate product quality disputes

Article 7 the national labor protection product quality supervision and inspection center shall meet the requirements of the basic conditions of national product quality supervision, inspection and testing center in terms of organization, personnel quality, instruments and equipment, environmental conditions and management system

Article 8 when undertaking the task of national standard labor protection product quality inspection, local labor protection product quality supervision and inspection stations must submit the organization, scope of responsibility, personnel quality, instruments and equipment, environmental conditions, product inspection methods, management systems, and the types and quantities of such products produced in the region to the Ministry of labor and personnel for approval. After approval, they shall be entrusted by the national labor protection product quality supervision and inspection center, And accept its business guidance and technical supervision
